Bellator's motion to dismiss two counterclaims against Eddie Alvarez was denied in a U.S. District Court yesterday, reports Sports Illustrated.The MMA promotion said that Alvarez's claims were "tortious interference" and "breach of contract." Judge Jose L. Linares ruled on a lack of factual information at the present time.
"Accepting the validity of Bellator's argument would require this Court to make a factual determination that Bellator, in fact, had a legitimate business-related justification for proposing a contract to Alvarez purporting to match the Zuffa offer," wrote Judge Linares. "It would be inappropriate for this Court to make a factual determination at this stage."
Alvarez and Bellator have been in court for months now. When Alvarez fulfilled his Bellator contract, the UFC offered him one. Bellator matched the deal, as per stipulations from the first contract, but Alvarez cried foul.
The former Bellator lightweight champion didn't feel competing on a Bellator card for Spike TV was equal to a UFC card on FOX or pay-per-view.
In January, Alvarez was denied an injunction to compete at UFC 159. He was recently spotted in attendance at Bellator 95, speaking with CEO Bjorn Rebney.
Since Bellator's inception, Alvarez is 8-1. After losing his belt to Michael Chandler, he bounced back with two first round finishes. Alvarez hasn't fought since October as the court battle continues.
